When Should the Master Answer? Respondeat Superior and the Criminal Law

Abstract Respondeat superior is a legal doctrine conferring liability from one party onto another because the latter stands in some relationship of authority over former. Though originally tort law, for past century it has been used within criminal especially to end securing corporations. Here, I argue that on at least prominent conception responsibility, we are not justified using this way. Firms answerable crimes committed by their employees, firms cannot answer as why crime was committed; they lack offer employee’s reasons action. rules out respondeat general principle, show contexts which vicarious still appropriate and respond number other concerns raised picture.
